Because we love dogs, we won’t work with every person that asks
us to work with their dog. Since most of our dog problems are really
PEOPLE problems, we won’t begin to work with a dog unless the owner is
prepared to change how they will live with their dog. That’s why people
refer business to us – we’ll tell the owners what they need to hear, not
just what they want to hear.

There are two reasons why dogs are difficult to manage.
-

The first reason is a Dog Problem: the dog’s temperament, breed
or socialization history interferes with learning and attention to what is
being taught. This might be a dog that is dangerous and should be put down
instead of kept. It also might be dog with unbalanced or weak drives,
necessitating extra lessons to get appreciable gains.

The second reason is a People Problem: There are several
manifestations of this situation:

The Mommy/Daddy that refuses to see a dog as a dog, preferring to
relate to the dog as a furry little baby;
-

The Overly Busy Person that shouldn’t have a dog;
-
-
The Cheapskate that won’t take proper care of their dog, even
though they have the money;

-
The Abuser or Neglecter;
-
-
The Mule, who has an ego problem; they can't listen to
instruction and they can't train a dog;
-
-
The Acquirer who gets a dog as a trophy instead of a companion –
the dog doesn’t really have a family;
-
-
The Whiffle-Whaffler, who keeps trying new methods, won’t stick
to the training program, keeps shopping around for new advice, and/or
listens to folks that aren’t trainers for training advice;

-
The Sluggard, who won’t keep up the necessary lessons, lifetime
training, socialization, and companionship.

If a prospective customer gets offended or won’t agree to Our
Rules or philosophy, then we know that the dog CANNOT stay at our doggie
daycare, tolerate grooming, be happy in boarding, or properly trained, and
we don’t want to work with them. As people of integrity, we would rather
know that we have confronted a person with the truth, and they rejected
it, than take their money and pretend that we are working with their dog
properly. we want to do an excellent job, and we figure that you are
hiring us because you know we want the very best result that we can
provide for you and your dog.

We hate having too many rules. We wish we lived in a world where
"a man's word was his bond", where people took personal responsibility for
their words and actions, where you could do business on a handshake, and
that people worked out their differences in a friendly and reasonable way.
But, unfortunately, things just aren't that way. We have to penalize the
95% of good people out there, by having to implement some business rules,
so that we can weed out doing business with the 5% of irresponsible dog
owners. We apologize for having to set some rules just to train your dog.

READ BEFORE COMMENCING: RELEASE OF LIABILITY AND NOTICE OF
INHERENT RISKS

By accepting and commencing an evaluation and/or lessons, you
agree to the following terms and conditions; this constitutes a contract,
which is binding on you and as guardian of any minor children accompanying
you. These services will only be made available on the terms set forth
herein. We are going to be evaluating, handling and training you and your
dog in the real world and
the real world has
hazards that can’t always be avoided (such as traffic, leashes
that break, crazy dogs that bite their owners, dogs that get around
fencing, parasites, diseases, injuries, and such like). Working with dogs
always involves substantial and inherent risks of injury, including death.
The risks include accidents, errors, and natural and man-made hazards. You
warrant you and your dog are physically healthy enough to be trained.
We reserve the right to work with other dog owners and
handlers and even your competitors, and you will not receive our services,
advice or training exclusively.
In consideration of the services provided or to be provided by Paws To
Play, all
minors shall be accompanied and supervised by a legal guardian or parent
whenever on the premises of Paws To Play, or when receiving or using or
practicing any of our services or training, and, regardless of whether the
guardian and/or parent are present or supervising, said guardian and / or
parent hereby agrees to indemnify and hold harmless Paws To Pay LLC, et al, from any
and all liability that might arise. You
shall provide complete and accurate details about your situation with your
dog. There is no guarantee made concerning the results of the training,
boarding, grooming or doggie daycare. In consideration for the use of
these services, you hereby release Dawn Kamp, Paws To Play LLC,
PawsToPlay.net, Sam Basso; Sam The Dog Trainer LLC, SamTheDogTrainer.com,
and its personnel, agents; other participants in the training; owners; and
affiliates from any and all claims arising out of or in connection with
these services whether the claims and liabilities arise by the negligence
of any said persons or otherwise, including costs and attorney’s fees.
Arizona law governs this agreement, and Maricopa County is the sole
jurisdiction and venue for court proceedings hereunder for all lessons.
All other disputes shall be governed by Arizona law, and Maricopa County
shall be the sole jurisdiction and venue for all other court proceedings
unless otherwise specified by us at our sole discretion and option.

All boarding, grooming, doggie daycare, lesson fees, equipment
fees, deposits and reservations shall be pre-paid, in full, in advance,
and non-refundable in any event. All sales are final. We want your dog
happy, well mannered and properly trained; people are more likely to
follow our recommendations and do the lessons when they have already spent
the money. In addition, there are other people wanting our time and the
use of our facilities, and once you get a time slot we have to turn other
people away, so prepayment ensures that you have a regular time in our
calendar. A deposit is for first right of refusal for an open pre-arranged
time slot; which must be used by you within 3 months, or shall be
forfeited. Prices and terms subject to change without notice. We reserve
the right, at our sole discretion, to refuse service to anyone for any
reason. Pre-payment is required to start training lessons and for other
services. Cancellations are subject to our Cancellation Policy.

Lessons, evaluations and seminars conducted outside the Phoenix
metropolitan area require prior approval by Sam Basso.
-
-
Never take the dog off lead, anywhere, unless the dog is
unsupervised (in which case it should be unleashed in a crate or kennel),
or we are working on off leash obedience exercises. You can’t control a
free running, untrained dog. You agree to use a correction collar to train
your dog, and agree that we will correct your dog as deemed appropriate by
the instructor. Aggressive, fearful some active, and some reactive dogs
require extra precautions, and we might require that you purchase and use
safety equipment. You shall have your dog drag a leash or long line at all
times, unless the dog is unsupervised or doing off leash exercises. You
agree to return any loaned equipment or supplies immediately upon request.
You shall arrive and leave with your dog on a leash. You shall not overly
excite the resident dogs when you come or leave.

IF YOUR DOG IS FEARFUL OR AGGRESSIVE: You shall not allow
strangers, children or others, or other dogs, to interact with your dog
without your direct supervision. An untrained dog can be dangerous
(especially if it is fearful, aggressive or highly reactive), some people
can’t be trusted to be alone with a dog, and we want to teach proper
greeting manners. You are responsible for ensuring the safety of yourself
and others. Never let your dog play with aggressive dogs. Such "play"
encourages learned dog aggression. No one plays "attack" games with the
dog. Rough games, chase games, and aggressive games must STOP! Training
can't prevent a dog from biting in all circumstances, but training can
sometimes control it. Before, during and after the training, you will
still have to diligently supervise, train, and contain a dog that has a
propensity to threaten and/or bite, as well as properly and diligently
educating and supervising those people that interact with and/or manage
the dog. Behavior modification with biting dogs is highly stressful for
the dogs, and we shall not be liable for any medical conditions that arise
as a result of the stresses your dog experiences during or after behavior
treatment.

No interruptions during lessons. We want your full attention and
We want you to get a good result. Each lesson is generally allotted up to
60 minutes, but may run longer or shorter.

Checks are made payable to Paws To Play. We charge a $50 fee for
a NSF check.
-
-
You agree to stay current on your homework and diligently do the
lessons as described. You will also obtain and use the materials and
equipment that we recommend and use them properly. You’ll need to be
present during some or all of the lessons. If you need help, put the dog
away and call us. There are usually no "quick fixes," so you might need to
buy extra lessons in some cases.

Vaccinations: Dogs, especially puppies, are susceptible to
diseases, some of which are fatal or extremely dangerous. You shall keep
all vaccinations current on your dog. If you aren't sure about any medical
issues, you shall consult your veterinarian and follow their
recommendations. We are not veterinarians. Dog Flu is highly contagious,
and you should expect your dog will contract the disease, and have a
chance of dying. We shall not be held responsible for a contagious disease
of any kind.
You agree to release, indemnify and hold us harmless from any and all
liability, claims and damages as a result of your dog, or any other dog,
contracting a disease as a result of doing business with us.

Bring Dog To Class Hungry. We sometimes use treats to train some
behaviors, and some dogs get upset stomachs when stressed by new
environments, training, or behavior modification. You will need to supply
your own treats for training. We recommend not feeding your dog at least 3
hours prior to using our services.

Potty your dog 5 minutes before arriving or commencing lessons.
You don’t want to pay us to poop your dog; you want to pay us to work your
dog.

Email Privacy Policy

From time to time, we receive very interesting emails and
letters. Typically they refer to some kind of behavioral problem. Since
this web site is a way for us to oftentimes educate about responsible dog
ownership, we shall sometimes use these inquiries and correspondence as
the basis of an article or as an example. By submitting any correspondence
or inquiry, you thereby agree that the materials and information submitted
are wholly your own, and you hereby give us permission to publish them in
whole or in part, for potential profit or for free, without compensation
to you of any kind, and to indemnify and hold us harmless for all claims
and damages arising out of anything you say. This information, if we
choose it for source material for this web site or other publication, will
usually (but not always) be reasonably stripped of direct information
about who you are, to protect your identity. This information shall then

Cancellation Policy
-

Boarding, Daycare and Grooming
cancellations are not permitted without the express written approval of
Paws to Play, thus full amounts shall be due and payable and
non-refundable once you schedule these services whether you show up with
your dog or not, whether you use some or all of the services or not. All fees and funds, prepaid, due or otherwise, are
non-refundable. Registrants who do not cancel within 48 hours prior to the
first commencement of doggie daycare, grooming, boarding, training,
consulting, other services, a lesson, evaluation or seminar or do not
attend are liable for the entire fee. Notice shall be by phone: (480) 966-9267. Because boarding,
grooming, doggie daycare, class size and schedules are very limited, all
cancellation/ rescheduling deadlines will be strictly adhered to so that
another customer or student may be accommodated. Exceptions are made on a
case-by-case basis. We reserve the right, at our sole discretion and
option, to terminate services and refund the remainder of your money, if
we feel that your dog is too dangerous or the situation is not going to
work out for the benefit of Paws to Play, the dog or owner. You agree to
contact us the moment a concern arises and don’t let any disappointments,
if any, build to the point of distress. We will not accept any
cancellations made through other means. We do not take any responsibility
for cancellation fees resulting out of reservations which need to be
cancelled due to the fact that a customer sent it "by mistake" or with
wrong dates or information, or fees paid and then the customer decides to
not continue with the lessons or services. In case you have any questions
regarding our services please send your question prior to reserving to our
email address. Our Rules shall control over any conflicting provisions of
any other agreement or any other document, except our written contract.
Once Boarding or Daycare services are scheduled, then all fees, including
those for Grooming and Training, shall be non-refundable to and
non-cancellable by the customer.

Training Session Cancellations: A Training Session
cancellation is different than a Service Cancellation. Training Sessions
can be rescheduled, but payment is still due for those lessons and lessons
once scheduled shall not be refunded except as described herein. Service
Cancellations shall not entail refund of any fees, regardless if the
customer receives the services or not, except according to the written
customer agreement entered into between the customer and Paws to Play. If
you have agreed to purchase training sessions, this portion of the cancellation policy applies: If you have fully prepaid for training, then you are allowed 3
lesson cancellations with no charge, however additional cancellations will
be counted as completed lessons and charged the regular price, however the
missed lesson prices shall not be deducted from the total amount due. If you have
not fully prepaid for Basic Obedience, they you are allowed 1 cancellation
and rescheduling with no charge. Cancellations must be made with previous day’s notice, or the fee
will be charged. Once lessons are commenced, all fees shall be due and payable.
Once you have obtained a lesson or lessons, the fees paid and/or due for
those lessons shall be nonrefundable without exception. All we have to
sell regarding training is our knowledge and expertise, some of which are trade secrets. This
is a service business and there is no possible way to "return merchandise
for a refund" once it is received. All sales are final. If you are not committed to paying for and
doing the lessons, then please either ask for more information about our
services, policies and references so you can comparison shop with our
competitors, or do not schedule lessons with us. A maximum of 3 cancellations are allowed, and a maximum
cancellation period of 1 week at a time is allowed, otherwise the entire
fee is forfeited, unless otherwise agreed upon. If an individual or company cancels a class or course without 10
days notice prior to the start of the class, they will be charged 100% of
the course fee. If a company
or individual does not attend a class and does not give prior notice, they
will be charged 100% of the fee. No refunds will be given. Private lessons are generally conducted every day, Monday through
Friday, to immerse the dog and owner in a new lifestyle, and group classes
will be scheduled at regular times. Our priorities: People safety is first,
dog/animal safety is second, and the results of training are third. We are
working with you as a team and we want this to be a positive experience
for you as well as for us. You agree to return phone calls immediately. We
shall each make a reasonable effort to work around holidays, planned
vacations, emergencies, birthdays, and scheduled days off, provided we
give each other advance notice; however, the total number of cancelled
and/or deferred days of lessons shall not exceed 30, otherwise the entire
fee shall be forfeited and non-refundable as liquidated damages. If you
commence lessons with another trainer during, and prior to finishing, the
lessons with us, said action shall be a breach of contract, and the
remaining fees paid, and all other fees due and not yet paid shall become
immediately due and payable, shall be forfeited and non-refundable as
liquidated damages, and the lessons with us shall automatically terminate;
you must be committed to doing this program and not shopping around after
the lessons are commenced, and such actions almost always materially
interfere with our training program, necessitating even more lessons. We
reserve the right to temporarily suspend lessons on a dog that is sick,
injured, infested, unfit, or needs grooming. The situation must be
remedied before the lessons are re-started, and we can require a vet’s
written certification and evidence. Cancellations need to be received by
our office at least 24 hours prior to arrival date and time of the
appointment, lesson, evaluation or seminar. For later cancellation
requests we cannot guarantee that there will be any refund.

General Cancellation Policies: We regret that we cannot make exceptions to the Cancellation
Policy for any reason, including personal emergencies. Regardless of
reason, cancellations result in a costly process of letters, toll calls,
adjustments, refunds, etc., plus a loss of revenue if time does not permit
resale of the lost reservation and cost of wages for employees. To offset these costs, our fee schedule
applies. In fairness to others, we cannot make exceptions. There will be no refund for no shows. All "No Shows" (customers
and students who do not cancel or reschedule within 48 hours prior to the
start of the course, as described herein) will be billed for the full
amount. This amount cannot be applied to future services, evaluations,
lessons, seminars or other courses. Except for times when there is heavy
traffic or bad weather conditions, we are normally on time or early for
lessons. From the time that the lesson is to begin, we will wait only 10
minutes for you to arrive if you are running late, but after that, we will
treat your appointment as a "no show". If you are running late, please
call. If you are more than 10 minutes late and we don't hear from you in
person (by phone) to discuss rescheduling, then we will leave, this will
be counted as a No Show cancellation, and you will be charged for the
lesson. We reserve the right to cancel or reschedule any scheduled
appointment.

Right of Dismissal: In order to maintain a classroom environment
that is conducive to learning, we reserve the right to dismiss a
participant from any service or training event. A participant who harasses
other participant(s) or Instructor(s) or Employee(s) or who in our sole
judgment acts inappropriately or disruptively may be dismissed from the
class or event and may not return. In case of such dismissal, our
liability will be limited to the refunding of any fees paid by participant
or participant's organization in respect of the course, for lessons not
yet completed, and we shall not be responsible for any consequential loss
or inconvenience arising whatsoever.

We reserve the right to cancel our services, an evaluation,
lesson, seminar or other training course any time prior to the start date
and time. It is our policy to obtain payment for attendance of any of our
programs in advance of the scheduled evaluation, lesson or seminar date.
In fairness to us and other students, if you do not attend a session for
which you are confirmed, you will be charged the entire fee. We will do
our best not to cancel or postpone any of our scheduled programs. However,
if for any reason if a program is postponed, the participants will be
notified prior to the scheduled program date by phone and/or e-mail. In
this regard, a participant may reschedule for a future program. We are not
responsible for travel expenses in the event of a program cancellation. We
reserve the right to postpone a program if necessary at any time.

Inclement Weather Policy: If we determine travel conditions to be
hazardous we will postpone or terminate classes. No refunds will be
issued. You may reschedule your class

Cancellation by Us

We have never cancelled a training course program, however we
have had to reschedule a lesson or service from time to time for
emergencies, illness, weather and such like. We reserve the right to
cancel a course at any time, for any reason. We will generally not cancel
a service or class except for "Acts of God", unusual or unforeseen
circumstances beyond our control. In the event that we cancel a class you
will be given a choice of choosing an alternative available future class.
When in doubt, or if the weather becomes harsh, please call us before
arriving.
